By engaging with The Handcrafted Tomato (“Company,” “we,” “us,” or “our”) and utilizing our catering, meal prep, or private chef services, you (“Client,” “Customer,” “Guest”) acknowledge and agree to the following terms and conditions.

1. INTELLECTUAL PROPERTY & CONFIDENTIALITY

All recipes, menus, branding, proprietary methods, and any other intellectual property created, provided, or used by The Handcrafted Tomato remain our exclusive property. Clients and third parties are strictly prohibited from copying, reproducing, distributing, or utilizing any of our proprietary materials without explicit written consent.

2. LIABILITY WAIVER & INDEMNIFICATION

By engaging our services, you acknowledge and accept full responsibility for any risks associated with catering and food consumption, including but not limited to:

A. FOOD ALLERGIES & DIETARY RESTRICTIONS

• The Handcrafted Tomato is NOT responsible for any allergic reactions, dietary sensitivities, or adverse effects resulting from the consumption of our food. It is the Client’s sole responsibility to disclose any allergies or dietary restrictions in advance.

• We take precautions to minimize cross-contamination, but we do not guarantee an allergen-free environment.

B. PROPERTY DAMAGE & AIRBNB RENTALS

• We are not responsible for any pre-existing property damage at rental homes, event venues, Airbnb properties, or private residences where services are performed.

• Any disputes regarding damage must be addressed with the rental property owner or management.

C. ACTS OF GOD & WILDLIFE INTERFERENCE

• The Handcrafted Tomato is not liable for any disruptions, damages, or cancellations caused by Acts of God, natural disasters, severe weather, or wildlife interference.

• This includes, but is not limited to, vehicle damage, loss of personal property, or unforeseen incidents beyond our control.

D. INJURIES, ACCIDENTS & FIRE LIABILITY

• The Handcrafted Tomato is NOT responsible for any injuries, accidents, or physical harm sustained by Clients, Guests, or any third party before, during, or after an event. This includes but is not limited to burns, cuts, slips, falls, food-related illnesses, or any other physical injury.

• We are NOT liable for any fire, smoke damage, or property destruction resulting from the Client’s use of kitchen appliances, open flames, candles, heating elements, or any other hazardous materials during the event. The Client assumes full responsibility for ensuring fire safety.

• The Client agrees to indemnify and hold The Handcrafted Tomato harmless from any claims, lawsuits, or damages related to injuries, accidents, or fires.

E. DRUGS, ALCOHOL & UNRULY CONDUCT

• We maintain a zero-tolerance policy regarding the use of illegal substances, excessive alcohol consumption, or any disruptive behavior during an event.

• If a Client or Guest is found to be under the influence and behaving in a way that disrupts service or puts our staff at risk, we reserve the right to immediately terminate services without refund.

3. SERVICE CANCELLATIONS & FORCE MAJEURE

• We reserve the right to cancel or refuse service for any reason, including but not limited to safety concerns, unforeseen circumstances, or violation of these terms.

• If an event must be canceled due to extreme weather, government restrictions, or any force majeure event, a rescheduling option may be offered at our discretion.

4. LIMITATION OF LIABILITY

Under no circumstances shall The Handcrafted Tomato or its affiliates, employees, or contractors be held liable for:

• Any direct, indirect, incidental, or consequential damages arising from the use of our services.

• Any injuries, illnesses, or property damage sustained during or after an event.

• Any loss of income or business disruptions resulting from service changes, cancellations, or delays.

5. AGREEMENT & ENFORCEMENT

By booking our services, the Client agrees to these legally binding terms. Any violations may result in immediate termination of services without refund and, where applicable, legal action.

Any disputes arising from these Terms & Conditions shall be governed by the laws of [Your State/Country], and legal proceedings must be filed in the appropriate jurisdiction.
